1. Introduction
Welcome to T-Park. These Terms of Service ("Terms") govern your access to and use of the T-Park mobile application, website, and related services (collectively, the "Platform"), operated by T-Park Technologies Inc., a company registered and operating under the laws of the Republic of the Philippines ("T-Park," "we," "us," or "our").
By downloading, installing, or using our Platform, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use the Platform. These Terms constitute a legally binding agreement between you and T-Park.
We reserve the right to update or modify these Terms at any time. When we make changes, we will revise the "Last updated" date at the top of this page and, where appropriate, notify you through the Platform or via the email address associated with your account. Your continued use of the Platform after any changes constitutes your acceptance of the revised Terms.
2. Definitions
For the purposes of these Terms, the following definitions apply:
- "Driver" means a registered user who uses the Platform to search for, reserve, and pay for parking spaces at participating facilities.
- "Owner" means a registered user who lists, manages, and operates one or more parking facilities through the Platform.
- "Facility" means a parking lot, building, garage, or other designated parking area listed on the Platform by an Owner.
- "Bay" means an individual parking space within a Facility, which may be designated as regular, PWD-accessible, EV charging, motorcycle, compact, or large vehicle.
- "Booking" means a confirmed reservation for a specific Bay or capacity slot at a Facility for a defined time period.
- "Session" means the actual period during which a Driver's vehicle occupies a parking space, beginning at check-in and ending at check-out.
- "Rate Plan" means the pricing structure set by an Owner for their Facility, which may include hourly, daily, weekly, monthly, or package rates.
- "Parking Pass" means a pre-purchased entitlement granting the Driver the right to park at a specific Facility for a defined duration (e.g., weekly, monthly).
- "Platform" means the T-Park mobile application, website, APIs, and all related services collectively.
3. Account Registration
To use the Platform's core features, you must create an account by providing accurate, complete, and current information, including your full legal name, a valid email address, a mobile phone number, and a secure password. You may register as either a Driver or an Owner.
You are responsible for maintaining the confidentiality of your account credentials. You must immediately notify T-Park of any unauthorized use of your account or any security breach. T-Park shall not be liable for any loss or damage arising from your failure to protect your account information.
You must be at least eighteen (18) years old and possess the legal capacity to enter into contracts under Philippine law to create an account. By registering, you represent and warrant that you meet these eligibility requirements.
Drivers who register vehicles on the Platform must ensure that all vehicle information (plate number, make, model, type) is accurate and corresponds to a vehicle they are legally authorized to operate. Providing false vehicle information may result in immediate account suspension.
T-Park reserves the right to suspend or terminate accounts that contain inaccurate information, are used fraudulently, or violate any provision of these Terms. We may also require email verification or additional identity verification before granting full access to certain features.
4. Services
T-Park provides a technology platform that connects Drivers seeking parking with Owners who operate parking Facilities. Our services include, but are not limited to:
- Location-based search for nearby parking Facilities with real-time availability information
- Online reservation and booking of parking Bays or capacity-based parking slots
- QR code-based check-in and check-out for tracked parking Sessions
- In-app navigation and turn-by-turn directions to selected Facilities
- Digital payment processing via supported methods (GCash, credit/debit card, cash)
- Parking Pass purchases for recurring parking needs (weekly, monthly)
- Session extension for active parking Sessions
- Digital receipts and billing history
- Facility management tools for Owners (bay management, rate plans, staff management, occupancy dashboards, revenue reports)
- Kiosk mode for self-service parking Facilities
- Dispute resolution between Drivers and Owners
- Push notifications for booking reminders, session alerts, and overstay warnings
T-Park acts as an intermediary platform and is not itself a parking operator. We do not own, manage, or operate any parking Facilities listed on the Platform. The contractual relationship for parking services exists between the Driver and the Owner. T-Park facilitates this relationship but does not guarantee the condition, safety, or availability of any Facility or Bay.
We may add, modify, or discontinue any feature or service at our discretion, with or without notice. We will make commercially reasonable efforts to notify users of significant changes that may affect their use of the Platform.
5. Booking & Reservations
Drivers may book a specific parking Bay or make a capacity-based reservation at a Facility through the Platform, subject to availability at the time of booking.
5.1 Booking Confirmation
A Booking is confirmed once you receive a confirmation notification within the Platform. You will be provided with a unique booking reference and a QR code for check-in. The confirmed Booking specifies the Facility, the Bay or capacity slot, the scheduled start and end times, the applicable Rate Plan, and the estimated cost.
5.2 Check-in
Drivers must check in by scanning the QR code at the Facility or having their QR code scanned by Facility staff. Early check-in is permitted up to fifteen (15) minutes before the scheduled start time. If you do not check in within thirty (30) minutes of your scheduled start time, your Booking may be automatically marked as a "no-show" and the Bay or capacity slot may be released to other Drivers.
5.3 Reservations
Reservations allow Drivers to reserve parking capacity at a Facility for a future date and time. Reservations may be bay-specific (a particular Bay is held for you) or capacity-based (a slot is reserved, with the specific Bay assigned upon arrival). Reservation policies, including advance booking windows and no-show thresholds, are set by each Facility Owner and displayed at the time of booking.
5.4 Walk-in Parking
Facilities may also support walk-in parking, where Drivers can begin a parking Session without a prior Booking. Walk-in availability is subject to real-time capacity and is not guaranteed. Walk-in Sessions are tracked from the moment of check-in to check-out and billed according to the Facility's applicable Rate Plan.
6. Payments & Refunds
6.1 Pricing
All prices on the Platform are displayed in Philippine Pesos (PHP) and are set by the Facility Owner through their Rate Plans. Rates may vary based on type (hourly, daily, weekly, monthly, package), time of day (dynamic pricing), day of the week, and Bay type (regular, PWD-accessible, EV charging, etc.). T-Park displays these rates transparently before you confirm a Booking. Some Rate Plans may have a minimum charge (e.g., a minimum of 2 hours for an hourly rate).
6.2 Payment Methods
T-Park supports the following payment methods: GCash, credit and debit cards (Visa, Mastercard), and cash (paid directly at the Facility). Payment is typically processed at the time of check-out. For Parking Passes, payment is collected at the time of purchase. T-Park may charge a small convenience fee for digital payments, which will be clearly disclosed before you complete the transaction.
6.3 Receipts
A digital receipt is generated for every completed payment. You may view and download your receipts at any time through the Platform. Receipts include the Facility name, parking duration, Rate Plan applied, base cost, any overstay charges, payment method, and the total amount paid.
6.4 Refund Policy
Refunds are processed according to the following general guidelines:
- Cancellations more than 2 hours before the scheduled start time: Full refund of any prepaid amount.
- Cancellations within 2 hours of the scheduled start time: A 50% refund may be issued, at the discretion of the Facility Owner. Some Facilities may offer a full refund; this is noted on the Facility page.
- No-show (failure to check in within 30 minutes): No refund is issued unless the no-show was due to a verified Platform error.
- Facility-side cancellations: If a Facility Owner cancels your confirmed Booking, you will receive a full refund.
- System errors: If a Booking fails due to a Platform error, any charges will be fully refunded.
- Parking Passes: Unused Parking Passes may be cancelled for a pro-rated refund within the first 48 hours of purchase. After 48 hours or first use, Parking Passes are non-refundable.
Refunds for digital payments are processed to the original payment method within five (5) to ten (10) business days. Cash payments must be refunded directly by the Facility Owner.
Disputes regarding refunds may be filed through the Platform's dispute resolution system. T-Park will review disputed charges and, where appropriate, mediate between the Driver and the Facility Owner. T-Park's determination on refund disputes shall be final and binding.
7. Cancellation Policy
Drivers may cancel a confirmed Booking or Reservation at any time before the scheduled start time through the Platform. The refund amount, if applicable, depends on the timing of the cancellation, as described in Section 6.4 above.
Facility Owners may set their own cancellation policies, which will be displayed on the Facility page at the time of booking. Owner-specific cancellation policies may be more generous (e.g., full refund up to 1 hour before) but may not be more restrictive than the T-Park default policy described in Section 6.4.
Frequent cancellations or a pattern of no-shows may result in the following consequences:
- A warning notification sent to your account
- Temporary restriction on making new Bookings
- Reduced priority in Facility search results
- In extreme cases, account suspension
T-Park considers a Driver a "no-show" if they fail to check in within thirty (30) minutes of the scheduled start time of their Booking. No-show thresholds may vary by Facility and will be indicated at the time of booking.
8. Overstay Policy
An "overstay" occurs when a Driver's vehicle remains in a parking Bay after the scheduled end time of their Booking or after the intended check-out time of a walk-in Session.
8.1 Grace Period
A grace period of ten (10) minutes is provided after the scheduled end time. During the grace period, no additional charges are incurred. You will receive a push notification when the grace period begins, reminding you to check out or extend your Session.
8.2 Overstay Charges
After the grace period expires, overstay charges are applied at a rate of 1.5 times (150%) the applicable Rate Plan. For example, if the standard hourly rate is PHP 40, the overstay rate would be PHP 60 per hour. Overstay charges are calculated based on the additional time parked beyond the grace period, rounded up to the nearest billing unit of the applicable Rate Plan.
8.3 Session Extension
To avoid overstay charges, Drivers may extend their active parking Session through the Platform at any time before the session ends, subject to Bay availability for the extended period. Extensions are billed at the regular Rate Plan rate (not the overstay rate). We strongly recommend extending your Session proactively to avoid penalty charges.
8.4 Persistent Overstay
Vehicles that remain in a parking Bay for an extended period without check-out or payment may be subject to additional actions by the Facility Owner, including but not limited to towing, clamping, or reporting to local authorities. T-Park is not responsible for any costs or damages resulting from such actions taken by the Facility Owner. Repeated overstays may result in account warnings, restrictions, or suspension.
9. User Conduct
By using the Platform, you agree to:
- Provide accurate and truthful information when registering, booking, and using the Platform
- Park only in your assigned Bay or designated area and respect the Facility's rules and signage
- Check out through the Platform when you leave the Facility and pay all applicable charges
- Not use the Platform for any unlawful, fraudulent, or malicious purpose
- Not attempt to manipulate availability, pricing, or booking systems through bots, scripts, or other automated means
- Not create multiple accounts to circumvent restrictions, bans, or no-show penalties
- Not transfer, share, or sell your account, Bookings, or Parking Passes to another person without authorization
- Treat Facility staff, other Drivers, and T-Park support personnel with respect and courtesy
- Report any safety concerns, security incidents, or Platform issues promptly through the appropriate channels
- Comply with all applicable Philippine laws, including traffic and parking regulations
Violation of these conduct guidelines may result in warnings, temporary restrictions, permanent account suspension, or legal action, at T-Park's sole discretion.
10. Facility Owner Responsibilities
Facility Owners who list parking Facilities on the Platform agree to the following responsibilities:
- Accurate information: Maintain accurate and up-to-date Facility information including address, operating hours, Bay count, Bay types, amenities, and photos.
- Compliance: Ensure that the Facility operates in compliance with all applicable Philippine laws, regulations, local government ordinances, and building codes, including but not limited to the Building Code of the Philippines, fire safety codes, and accessibility requirements under the Magna Carta for Disabled Persons (RA 7277).
- Verification documents: Submit all required documents for Facility verification, including valid business permits, proof of ownership or lease, and other documents as required by T-Park.
- Fair pricing: Set reasonable and transparent Rate Plans. T-Park reserves the right to flag or suspend Facilities with pricing deemed exploitative or misleading.
- Availability accuracy: Keep Bay availability and Facility status current. Do not accept Bookings for Bays or capacity that is unavailable.
- Safety and security: Maintain a reasonably safe parking environment, including adequate lighting, signage, and security measures appropriate to the Facility type.
- PWD compliance: Designate PWD-accessible parking Bays as required by law and ensure these spaces are properly marked and accessible.
- Dispute cooperation: Respond to Driver disputes filed through the Platform in a timely and good-faith manner. Cooperate with T-Park's dispute resolution process.
- Staff management: Ensure that Facility staff who use the Platform (managers, attendants, scanners) are properly trained and authorized to perform check-in/check-out operations.
- Tax obligations: Comply with all Philippine tax obligations, including the issuance of official receipts where required by the Bureau of Internal Revenue (BIR).
T-Park reserves the right to suspend or permanently remove any Facility that fails to meet these responsibilities, receives consistently poor Driver feedback, or poses safety or legal risks.
11. Intellectual Property
All content, features, and functionality of the Platform, including but not limited to the software, design, text, graphics, logos, icons, images, data compilations, APIs, and underlying source code, are the exclusive property of T-Park Technologies Inc. or its licensors and are protected by Philippine and international copyright, trademark, patent, and other intellectual property laws.
The T-Park name, T-Park logo, and all related names, logos, product and service names, designs, and slogans are trademarks of T-Park Technologies Inc. You may not use these marks without the prior written permission of T-Park.
You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Platform for your personal, non-commercial purposes (or for your business operations as a Facility Owner). This license does not include the right to:
- Modify, copy, or create derivative works based on the Platform
- Reverse engineer, decompile, or disassemble any part of the Platform's software
- Scrape, harvest, or extract data from the Platform using automated tools
- Use the Platform's content for commercial purposes without written authorization
- Remove, alter, or obscure any copyright, trademark, or other proprietary notices
Any content you submit to the Platform (such as Facility descriptions, photos, or reviews) remains your property, but you grant T-Park a worldwide, non-exclusive, royalty-free license to use, display, reproduce, and distribute such content in connection with operating and promoting the Platform.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, T-Park, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR:
- Any loss, theft, or damage to your vehicle or personal property while parked at any Facility
- Personal injury occurring at any Facility listed on the Platform
- Actions or omissions of Facility Owners, their employees, or agents
- Inaccurate Facility information provided by Owners, including incorrect Bay availability, operating hours, or pricing
- Service interruptions, Platform downtime, or technical errors beyond our reasonable control
- Lost revenue or business opportunities resulting from Platform issues
- Any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform
T-Park's total cumulative liability for any claims arising out of or related to these Terms or your use of the Platform shall not exceed the total amount you paid to T-Park in the twelve (12) months preceding the claim, or One Thousand Philippine Pesos (PHP 1,000.00), whichever is greater.
The Platform is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. T-Park does not warrant that the Platform will be uninterrupted, error-free, or completely secure.
13. Termination
You may terminate your account at any time by contacting T-Park support or using the account deletion feature within the Platform. Upon termination:
- All active Bookings and Reservations will be cancelled
- Any outstanding payments must be settled before account closure
- Active Parking Passes will be forfeited without refund (unless within the 48-hour cancellation window)
- Your personal data will be handled in accordance with our Privacy Policy and applicable data retention laws
T-Park reserves the right to suspend or terminate your account at any time, with or without cause, with or without notice, including but not limited to the following circumstances:
- Violation of these Terms or any applicable law
- Fraudulent, abusive, or harmful conduct
- Providing false or misleading information
- Persistent no-shows, overstays, or unpaid charges
- Receiving multiple verified complaints from other users or Facility Owners
- Inactivity for a continuous period of twenty-four (24) months
Upon termination by T-Park, you will be notified at the email address associated with your account. You may appeal account suspensions by contacting our support team within thirty (30) days of the suspension notice.
14. Governing Law
These Terms shall be governed by, construed, and enforced in accordance with the laws of the Republic of the Philippines, without regard to its conflict of law principles.
Any dispute arising out of or in connection with these Terms, including any question regarding its existence, validity, or termination, shall first be resolved through good-faith negotiation between the parties. If the dispute cannot be resolved through negotiation within thirty (30) days, either party may submit the dispute to mediation under the rules of the Philippine Dispute Resolution Center, Inc. (PDRCI).
If mediation fails to resolve the dispute within sixty (60) days, the dispute shall be referred to and finally resolved by arbitration administered by the PDRCI in accordance with its Arbitration Rules. The seat of arbitration shall be Metro Manila, Philippines. The language of the arbitration shall be English.
Notwithstanding the above, either party may seek injunctive or other equitable relief in the proper courts of Metro Manila, Philippines, to prevent the actual or threatened infringement, misappropriation, or violation of intellectual property rights.
These Terms are also subject to, and shall be interpreted in accordance with, the following Philippine statutes where applicable: the Civil Code of the Philippines, the Consumer Act of the Philippines (RA 7394), the Electronic Commerce Act (RA 8792), the Data Privacy Act of 2012 (RA 10173), and such other laws and regulations as may be relevant.
